WYATT S. EARP AND HIS FATHER, NICHOLAS P. EARP
A fine rarity, a document filled-out and signed by both WYATT S. EARP (1848-1929) and his father, NICHOLAS PORTER EARP (1813-1907). Son Wyatt, of course, was the frontier lawman and gunfighter who, with brothers Morgan, Virgil and Doc Holliday, fought the legendary gun battle with the Clanton and McLaury brothers at the OK Corral on Oct. 26, 1881. This partly-printed document, 1p. oblong 8vo., is a summons issued in Lamar, Barton Co., Mo. on July 21, 1870 seeking "Dr. Dunn Levy Halman old Bobby Patten John Cockrell Carrol Cockrell J J Humphrey" to answer a complaint brought by Theodore Edwards, Samuel Jones and Joseph Graham. Nicholas has filled out the form and signed "N. P. Earp" at bottom. On verso, Wyatt writes: "I have served the within subpoena upon the within Names werin [sic] mention [ed] by Reading the same to them this July 22nd 1870 W. S. Earp Const. ". A few trivial stains, else very good. In 1868 the elder Earp, a veteran of the Black Hawk and Mexican Wars, and a convicted bootlegger as well, moved to Lamar and was appointed Justice of the Peace. Son Wyatt, named after an Illinois military officer under whom Nicholas had served, was immediately appointed constable. Wyatt Earp married Urilla Sutherland on Jan. 10, 1870, and she died later that year in childbirth, along with the infant. Wyatt got into a serious quarrel with her brothers, left town and drifted into Kansas.
