SOUTH CAROLINA MARRIAGE INDENTURE NAMES THIRTY-THREE SLAVES
A very interesting antebellum manuscript D.S., 6pp. legal folio, Beaufort, March 14, 1844, an indenture related to the marriage of an Edward Walker to an Ann Buell Barnwell, transferring property owned by the latter to a relative as a trustee, a John G. Barnwell, including her plantation and thirty-three slaves, listed by name. In small part: ‘...Whereas a marriage is about to be had and concluded between the said Edward Walker and Ann Buell Barnwell and whereas the said Ann Buell Barnwell is seized and possessed in her own right of certain Real and Personal Estate, consisting of a plantation and negroes hereinafter described and enumerated… she the said Ann Buell Barnwell… hath bargained granted sold and delivered… unto the said John G Barnwell… the said real and personal Estate to wit: An undivided Moiety of that plantation or tract of land situated on Port Royal Island… Also the following slaves. Maria, Susan, Harry, Nancy, Clorinda… Betsey, Jane, Rose, Jane, Dinah, Phibby, Dorcas, Celia, Marcus, Charlotte, Comba, Chloe, Cuffy, Sarah, Kate, Nancy, Hannah, Comba, Peggy, Aleck, Bob, Jimmy, Lydia, Delia, Stepney, Jack, Luanna, Sibby. To have and to hold… all and singular the said slaves with the future issue and increase thereof…' The document is concluded with an autograph attestation by magistrate ROBERT W. BARNWELL (1801-1882), later a signer of the Confederate Constitution, chairman of the provisional Confederate Congress and a senator throughout the Civil War, dated Nov. 14, 1844 at Charleston, affirming that the agreement was executed by the parties in his presence. He signs ‘R W Barnwell' twice at the conclusion, once again above as a witness, and again in the body, executing his surname ‘Barnwell' four more times in listing the parties, undoubtedly relatives. Shows expected folds with minor splits thereto, with the final page mildly soiled and toned, otherwise in very good condition overall.
