(NUREMBERG TRIALS)
An interesting group of T.L.S.s and other pieces by various individuals relating to Dr. Fritz Sauter, a German lawyer and defense counsel to Joachim von Ribbentropp, Walter Funk and Baldur von Schirach at the Nuremberg Trials. Comprises, in chronological order: an official English translation of a document by Sauter addressed to the Secretary General of the International Military Tribunal, 1p. 4to. Nuremberg, Dec. 17, 1945, in part: ‘…Last week I requested that a certificate be made out for me that I can present to the Housing Office in Munich to prevent requisitioning of my home and office…I received a special delivery letter from Munich yesterday, according to which the rooms used by me up to now are to be requisitioned. Thus I am running the risk of being without quarters in Munich after the end of the Nurnberg Trial, and I am convinced that the…Military Tribunal in no way sanctions what amounts to a punishment for my activity in this court…'. With a D.S. by Brigadier General WILLIAM A. MITCHELL (1897–1974), General Secretary of the International Military Tribunal, in part: ‘…It is requested that the attached petition from Dr. Sauter…The Tribunal has informed defence counsel that it expects that each of them will regard his duty…as of the first and most pressing importance. Consequently, counsel are not entitled to be absent from the sessions…without the expressed permission of the Tribunal. Since Dr. Sauter is assisting in the trial, the Tribunal is anxious that he should not suffer the loss of his office…'. Additionally, a typed D.S. by American Brigadier General LEROY H. WATSON (1893-1975), 1p. oblong 8vo., Dec. 18, 1945, to the Commanding General of the Third United States Army, stating that is in the interest of the court that Dr. Sauter's office and apartment not be taken from him during the Trials; a typed D.S. by Captain R. A. KNIGHT, Headquarters, Third United States Army, Feb. 20, 1945, concerning Sauter's request, in part: ‘…It will be noted that the action recommended by OMG is not based on Dr. Sauter's present activities but upon his past record…the Director, Office of Military Government of Bavaria has been requested to withhold further action; a typed D.S. by Capt. AUGUSTUS B. HILL, Social Insurance, Benefits and Housing Section Manpower Branch, 2pp. 4to., Office of Military Government of Bavaria, Feb. 20, 1946, a memorandum address to Lt. Edward T. Diaz at the Headquarters of the Third United States Army, in part: ‘…The housing case of Dr. Sauter has been investigated by this office…According to the records of the Investigation Section…Sauter...Counsel for the Defense of War Crimes…joined the Nazi party in 1941. His Nazi affiliations are further shown by his membership in the NSKK and NSRB. In September, 1940, Dr. Sauter applied to the Police Presidium, Munich, for permission to carry a pistol; this request was referred to the Gestapo...they had no objection…the apartment and office of Dr. Sauter has been taken over by the Housing Office in order to accommodate former concentration camp inmates and victims of the Nazi persecutions…Information received by this office indicates that Dr. Sauter was not only a member of the Nazi party, but also, in every sense of the term, and ‘activist'. The report is that up to the time of the occupation by Munich of our troops, Dr. Sauter was denouncing and condemning the Allies bitterly. That he was ‘an avowed believed in Nazism' seems beyond dispute…Housing policy…states…no Nazi is permitted to live under conditions more favorable than those enjoyed by other persons in the community. It is a matter of the German authorities to decide if compliant with this policy requires the eviction of any Nazi from his home…It is therefore the opinion of this office that the German Housing Office of Munich was within its rights…to require Dr. Sauter to relinquish his former premises…'; a typed D.S. signed in pencil by British Lt. Colonel AIREY NEAVE (1916-1979), 1p. sm. 8vo., Mar. 22, 1946, a memorandum, in part: ‘…Dr. Sauter was not appointed by the court. I have informed him of the circumstances and the papers have been referred to C.I.C. [Counter Intelligence Corps] who have no comments…', also annotated and signed by LEROY H. WATSON with initials. Each document is neatly laid-down on the recto and verso of a larger sheet, light staining, very good. Provenance: from the archives of Dr. Hans Werner, responsible for directing the printing of the Record of the Trial of Major War Criminals in 42 volumes and in three languages immediately following the Nuremberg Trials.
