NOAH H. SWAYNE
(1804 - 1884) American jurist and politician. He was the first Republican appointed as a justice to the Supreme Court. Swayne had represented fugitive slaves in court, making his choice by Lincoln an easy one. Fine association A.L.S., 2pp. 4to., Columbus, Mar. 11, 1846 to U.S. Supreme Court Justice John McLean. McClean, a dissenter in the Dred Scott case, would later recommend Swayne to Abraham Lincoln as his replacement on the bench, and Lincoln would ultimately heed that recommendation. Swayne asks the then-U.S. attorney asks detailed questions concerning bail, then moves into politics: "...At one time serious apprehensions were felt that the bungling management of the administration would result in the breaking out of the flames of war...still grows...the apprehension that the bullying...may drive Polk into a course of action that will involve the country still further in embarassment - and danger of conflict...Polk has worn the two faces of the god of war...Some of the 'old Humpkins' would prefer Clay - but even they admit that to bring him out would be a sort of fallen hope affair...".
