LAND GRANT TO NORTH CAROLINA PATRIOT COL. WAIGHTSTILL AVERY
WAIGHTSTILL AVERY (1741-1821) Early American lawyer and officer in the North Carolina militia during the American Revolution, one of the early proponents for that colony's independence from Great Britain. Avery was elected to the North Carolina Provincial Congresses in 1775, and in that capacity helped draft the first Constitution of North Carolina in 1776. He served as the first Attorney General for the state from 1777 to 1779, and fought a duel with future president Andrew Jackson in 1788. He was purported to be a signatory of the ‘Mecklenburg Declaration of Independence', which was claimed to have been the first such declaration made in the Thirteen Colonies during the American Revolution, although its existence has been discredited by historians. Interesting manuscript document, 2pp. legal folio, Burke County, NC, Aug. 7, 1787, a pair of land grants for two tracts belonging to Avery in western North Carolina, one on Cane Creek and the other on Rock Creek. The grants include hand-drawn surveys of each tract, with verbal descriptions below, each signed by a ‘W. Stafford' at the conclusion, and listing the names of the ‘chain carriers' involved in the survey. Shows expected folds with minute splits at the junctures, with a small area of rodent damage at top right on the first page, otherwise in very good condition. Worthy of further research!
