HEINRICH HIMMLER (1900 - 1945) Hitler's Chief of the Gestapo placed in charge of security and responsible for the construction and operation of extermination camps. He chose suicide rather than face a hangman's noose at Nuremburg. Fine content retained copy of a letter signed with rubber stamp signature, the original sent to REINHARD HEYDRICH (1904-1942), 2pp. 4to., Berlin, Dec. 28, 1936. In small part: '...During a lecture by the Reich Minister of Justice on the effects of the illegal law, the Fuhrer and Reich Chancellor expressed concerns about the large scope of the criminal prosecutions and ordered that the following aspects should be considered when examining whether the criminal prosecution should be approved or not...If an accused has made a criminal offense...for the first time, it must be fundamentally checked whether a warning is not already sufficient...to prevent a repetition...Furthermore, with the question of whether a warning can suffice, the personality of the perpetrator and also the accompanying circumstances under which the statements were made are decisive...(drunkenness, slipping out of anger, un-deliberate talkativeness, influenceability of the listeners, etc.)...These guidelines are also observed by the Secret State Police, especially when ordering protective custody because of statements hostile to the state. Therefore, when examining whether protective custody has been ordered or not, the focus is primarily on the perpetrator and, to a greater extent, on the content of the statement...If, based on the person of the perpetrator, the statement must be viewed as a manifestation of his anti-state attitude and the person of the perpetrator makes state police action necessary, protective custody can be ordered. If these requirements are not met, only a severe warning is to be issued...' Marginal file holes, else very good.
