HENRY E. MCCULLOCH
(1816 - 1895) Confederate brigadier general in command of Texas' defensive forces and led a brigade in an attempt to relieve Vicksburg. Rare war-date A.E.S. penned at the conclusion of a legal writ in which McCulloch is personally served with a petition for a writ of habeas corpus in the case of James Lane vs. Brig. Genl. Henry E. McCulloch! Lane's plea, 2pp. sm. folio, sworn to in Bonham on Sep. 17, 1864, states in part: "...at his own fireside with his family he was captured by an armed band of men by violence and under personal restraint...forced from the county...now held in confiement...by one Brigadier General Henry E. McCullock...Petitioner states he is illegally restrained of his liberty...has given his aid as a good citizen to his country in her struggles for Independence...militarty authorities have no control over him...". At bottom of second page, McCulloch curtly responds: "Respectfully returned to the Clerk of the Court. My answer is in letter No. 131.9. H. E. McCulloch Brig. G. C.S.A." Toned folds, one bisects signature, else very good.
