(1726 - 1806) American jurist and statesman, a Virginia Signer of the Declaration of Independence who taught law to Thomas Jefferson, John Marshall and Henry Clay. Scarce A.D.S., 2pp. 8vo., Orange County, Va., June 1749, as attorney for the plaintiff in the case of Madison v. Philips. A peculiar case in several respects: firstly, the plaintiff, named James Madison, was quite possibly the father of President James Madison; second, the case is both a combined civil and criminal case. Wythe writes in part: '...James Madison who as well for our Sovereign Lord the King as for himself prosecutes in this Behalf, complains of Joseph Philips in Custody, &c. of a Plea of Debt [of]...two thousands Pounds of Tobacco, which he owes to, and unjustly detains from them...' On top of the unpaid debt Philips was charged with selling '...by Retain in his House...one Pint of Brandy, one Pint of Rum, one Pint of Wine, one Pint of Cider and one Pint of Beer without first having had and obtained a License...' Madison and the King for that matter did not prevail however. In the docket the jury forman writes 'We of the Jury find for the Defendant Bryan Sisson.' Light toning, otherwise very good condition.
