Description:

CHARLES HARDY
(1714-1780) Royal Navy officer and colonial governor of New York from 1755-1758. He also served in the naval forces during the siege of Louisbourg (1758) and the Battle of Quiberon Bay (1759). Fine content A.E.S. at the conclusion of a manuscript document, 4pp. legal folio, [New York, c. 1758] being a report on the legal issues surrounding the seizure of a French ship by a private English merchant ship, not a privateer. The document reads, in small part: "...The French Snow[,] Bon Bon venture being Seized on the High Seas by an English Ship without Commission as Private Ship of Warr [sic] or Letter of Marque brought into Sandy Hook where she was boarded by some of the Crew belonging to the Fox Privateer of the Port of New York under Pretence that they had a right of taking her from the Merchant Ship who first Seized her in her Passage from the Island of Maderia to Maryland, in company with a Schooner from the said Island to this Port, for want of such commission, and they were proceeding with her up to this City, said French Snow was boarded off the Red Hook by an Officer & Men belonging to his Majesty's Ship Sutherland laying at Anchor in this Port, who also lay claim to the said Snow upon the same Principle with the Crew of the Privateer who had presented a Libel in the Court of Admiralty praying Condemnation of the said Snow, as they say having taken her upon the high Sea, and the Captain of the Sutherland intending to Libel in behalf of himself Officer & Ship's Company..." Hardy adds his comments on the quandary on the final page. Worthy of further research and a fascinating peek into the web of legalities surrounding the work of privateers and the navy during the French and Indian War. Usual folds, light uneven toning, else very good condition.
