[ Autographs ] FELIX FRANKFURTER (1882 - 1965) Supreme Court Associate Justice, founder of the A.C.L.U. and a leading exponent of judicial self-restraint. Good content T.L.S. "F.F." on Supreme Court letterhead, 1p. 4to., Washington, Nov. 3, 1950, to Chief Justice Fred Vinson regarding a decision. In part: "...I thoughtlessly framed by inquiry regarding No. 176, Harding v. United States, as to ask the brethren to state whether they would affirm or reverse instead of whether they would grant or deny certiorari, and if it was to be granted whether they would reverse summarily or after argument. The returns indicate that that [sic] five of the Brethren would affirm thecase if it came here. That being so, it would require my vote to bringthe case here...I do not feel warranted in voting to bring the case here....therefore vote to deny the petition for certiorari...". Docketing at top right, a staple hole at top left, and a "Received" stamp at bottom, else boldly initialed and very good. An interesting look into the inner workings of the Vinson court.
