Description:

ABRAHAM LINCOLN
(1809-1865) Sixteenth President of the United States who led the Union through the Civil War and emancipated the slaves, assassinated. Legal A.D.S. "Parker & Lincoln p. d." (signed four times) 2pp. legal folio, [Pekin, Ill., Sept. 16]. 1852, with several corrections and emendations being a writ for Scrie facias in the case of Eggleson v. Perkins in which Perkins was accused of failing to pay Amos Eggleson the sum of $102 but Perkins failed to satisfy the judgment. Perkins retained Lincoln's services arguing that he had in fact paid the judgment. In the writ, Lincoln notes that "...he [Perkins] fully paid to the said plaintiff the amount due upon said judgment, in evidence of which the plaintiff gave the defendant a receipt in full of all demands, bearing date Jan: 16th 1852... after the rendition of the judgment and before the brining of this writ, he, said defendant, was wholly insolvent, having no property whatever, liable to execution; and being so insolvent, the said plaintiff accepted twenty five dollars of the defendant, in full discharge of the said judgment..." Lincoln lost this case: jury found for Eggleston, awarding him $110.45. A very clean and fine example of Lincoln's legal work in Illinois. Usual folds, extreme light toning at edges, else very fine condition.
