802. JAMES F. FAGAN (1828-1893) Confederate major general at Shiloh and Prairie Grive, later was with Sterling Price in his last Missouri raid. Rare D.S. "J.F. Fagan" as U.S. Marshal, 2pp. legal folio, Fort Smith, Ar., June 8, 1876, his attestation that the formation of a posse comitatus was "...absolutely necessary to the due and proper service and execution of said warrants...a posse comitatus could not have been obtained any nearer than [where]...employed..." The posse had been organized to arrest the subjects of this deposition, one Stephen Dock: "...charged with Larceny in the Indian Country, Henry Bogles charged with Larceny, and one Holliday, charged with violation of the Revenue Laws..." The sheriff who made the arrests, Edward S. Brooks, further states that he traveled over 600 miles in pursuit of the criminals, and charges the government ninety dollars for his services.
