Description:

(DISPUTING THE OATH OF ALLEGIANCE)
A.L.S. 2pp. legal folio, Richmond, Aug. 5, 1865 in which E. M. Garnett writes John D. McPherson in New York disputing his need to take an oath of allegiance. In part: "...My 'legal status' is very good so far as I am aware. I took the oath on the 29th April last under President Lincoln's amnesty proclamation...I have not taken the oath under President Johnson's proclamation as I do not consider I am one of the excepted class, & have nothing to be pardoned for...I never considered Washington my home & never voted there...I only came home when the war commenced, and my office was not a judicial one...I never held an office under the Confederate Government...". Very good.
