Fascinating manuscript D.S. 50pp. legal folio attached with ribbon at top margin, Austin, Tex., Jan. 13, 1869 detailing a suit in which the executors of the estate of E. S. Buck seeks payment on promissory notes signed by Reuben Loggins in 1860 and 1864 for rent of seven slaves and a plantation. In defending his non-payment, Loggins argued that the parties had agreed to void the notes in the event of a civil war. However Loggins was unable to provide any evidence of such an agreement. He then argued that he had offered payment in Confederate currency, which the holder of the notes refused; and that, "by reason of war the property was rendered unproductive and valueless." In 1868, a jury found Loggins liable for the debt. This document records Loggins' appeal to the Texas Supreme court and includes the details of the district court proceedings, including pleadings and other filing by the parties to the suit, the courts' charge to the jury, depositions, witness statement summaries, and post-trial motions. The Texas Supreme Court found against Loggins, finding his various defenses insufficient as a matter of law (and reported at 33 TX Reports 113, [1870]). Marginal wear including minor chips and tears, else very good.
