Terms and Conditions of Sale - Auctions


1. This auction is conducted under the laws of the State of Connecticut.
2. This auction will be held in two parts. Part I (lots 1-554) will begin at 11:00 AM Eastern time on Tuesday, April 29, 2008
Part II (lots 555-1146) will begin at 11:00 AM Eastern time on Wedesday, April 30, 2008- however, you may place bids at any time prior to the sale dates.
3. There is a 17.5% Buyer’s Premium charged on the final hammer price of each lot. An additional 5% Buyer’s Premium will be added to lots purchased through ebayliveauctions.com. Lots purchased through our website (alexautographs.com) or by any other means other than ebayliveauctions.com bidding service are not subject to this additional fee.
4. The Auctioneer reserves the right to reject any bid for any reason.
5. The Auctioneer reserves the right to withdraw any lot for any reason.
6. In the event of duplicate high bids, the earliest bid received BY THE AUCTIONEER will be the winner. Please note absentee bids left with ebayliveauctions.com do not reach the auctioneer until the lot opens during the live sale.
7. Some lots may carry a reserve beneath which the item will not be sold. Any reserve will always be at or below the low estimate.
8. Detailed descriptions of lots and photocopies are available upon request.
9. Illustrations of lots in this catalog and our website may have had size and/or contrast modifications for display purposes.
10. Estimated selling prices are for your guidance only. Actual selling prices may be higher or lower than the estimate indicated.
11. The placing of a bid legally binds the bidder to purchase the lot at or below the bid placed, plus buyer's premium (see item 3). Bids may not be retracted without our approval. Please think before you bid! You are legally bound once you bid.
12. Absentee Bidding. All bidding is undertaken in a competitive manner. The winning bid will always be one bidding increment over the second highest bid. The minimum acceptable bid for any lot is one-half of the low estimate given in the item description or $20.00, whichever is greater. Bidders may call us at 203-276-1570 during office hours to check the status of their bids, or check bids anytime on our website. Absentee bids are accepted up to one hour before the start of the auction. Live bidding: Bids entered during the course of the sale by bidders on the floor, on the phone, or live on the internet will be taken at the amount bid.
13. Payment is expected immediately upon, (but not before) receipt of invoice. Payments may be made via mail, phone, fax, in person, or online at alexautographs.com (click on Make Payment link). We also accept PayPal payments, payable to sales@alexautographs.com. All accounts are payable to Alexander Autographs, Inc. Payment must be made in U.S. funds. Wire transfer details are available upon request. Please note that lots purchased are subject to sales taxes where applicable unless a resale number is filed with us prior to the auction. Invoices not paid within thirty days of the date of invoice will incur a 1.5% per month late payment fee.
14. Shipment is made via United Parcel Service unless otherwise instructed. Handling, shipping and insurance charges will be added to the invoice.
15. All material in this sale is guaranteed genuine for life (unless otherwise stated) to the original buyer. Any item sold which is determined to be not authentic by two independent authenticators acceptable to both parties to the sale may be returned by the original buyer at any time for an immediate refund of the purchase price (only).
16. Items may also be returned if the catalog description differs significantly from the item’s actual condition; such returns must be made within three (3) days of purchaser's receipt of the lot(s). All returned lots must be in the same condition as shipped. All items are in very good condition unless stated otherwise. Items housed in frames have not been examined outside of the frame. Lots which bear defects or damage not visible because of framing or otherwise will not be subject to return.
17. Any lot containing 5 or more items is not subject to return for any reason.
18. We do not examine the condition of items contained within frames beyond what is visible within the frame, therefore we are not responsible for any damage or defect not visible to us, including mounting, silking, marginal damage, etc. Bidders are advised that we are selling the autograph, not the frame, and therefore the condition of the frame shall not be considered reason for return. Shipping costs for framed items may vary greatly depending on the size and/or weight of the frame, and at times these charges may be quite substantial. Customers may request us to remove an autograph from its frame to reduce shipping charges. We will accommodate customers in that respect for an additional charge of $10.00 per framed item, but such service will be undertaken at our sole discretion. Alexander Autographs will be responsible for any damage caused to the VISIBLE area of the item as it appears in the frame. We will in no way be responsible for any pre-existing hidden damage or defect, nor will we be responsible for any damage caused by us to any previously hidden portion of the autograph, its mount, or any material matted with the autograph during removal from the frame.
19. The placing of a bid shall constitute acceptance of the preceding terms and conditions of sale as well as the Bidding Procedure guidelines posted below.

AUCTION RESULTS WILL BE AVAILABLE ONLINE LIVE ON THIS SITE AS EACH LOT CLOSES.

Bidding Procedure
Please note that by submitting a bid in this auction you agree to all the terms and conditions of sale as stated above.

Absentee Bidding

Absentee bids are accepted on all lots in this auction and may be submitted by mail, fax, telephone or e-mail. As noted in the terms and conditions of sale, these bids will be taken competitively. In other words, your bid is interpreted as a ceiling bid. If you are the high bidder on a particular lot, the hammer price will be determined as one increment above the next highest bid received.

Bids can be submitted as soon as you receive this catalog or when it appears online. Absentee bids placed by telephone will be accepted from 10 AM to 5 PM Monday through Friday except on sale dates where bids will be accepted until one hour before the commencement of the live sale.

Please do not wait until the last minute to submit your bids as our telephone lines become quite busy.

Live Telephone Bidding (during live auctions only)

Bidding live via telephone is available on a first come, first served basis. Phone line reservations for both Part I and Part II must be made prior to 6 PM, Eastern Time, on the day before the sale. Do not wait until the last minute to reserve a phone line for your desired lots as availability is very limited. You may make reservations by calling us at 203-276-1570.

Bidding in Person (during live auctions only)

If you intend on bidding in person during the auction, please call ahead and we will happily provide directions to our Stamford, Connecticut offices.

Live Internet Bidding

All lots will be available for bidding live on the internet via eBay at www.ebayliveauctions.com. We recommend registering twenty-four hours prior to commencement of each part of the auction.

Condition of lots
As noted in the terms and conditions of sale we attempt to describe the condition of our material according the criteria set forth by the Manuscript Society. We encourage you to view the lots in person to inspect condition. If you are unable to come and view the material in person, we encourage you to call us at 203-276-1570 and we will be happy to answer your questions regarding the condition of any lot in this catalog.

Public Viewing of Lots

We will make the material in this catalog available for viewing at our Stamford, Connecticut offices by appointment. On sale days lots will be on view 9 AM to 11:30 AM.

Bidding Increments

Please note the following bidding increments. All out-of-increment bids submitted on an absentee basis will be rounded down to the nearest increment. In other words, a bid of $225.00 will be rounded down to $220.00. A bid of $567.33 will be rounded down to $550.00. All bids are taken competitively and we will bid up to the specified number as necessary.

Please also note that we will not accept "either/or" bids, nor do we accept "+1" bids.
