316. JOHN MARSHALL (1755 - 1835) Supreme Court Chief Justice and the principal founder of the American system of constitutional law, including the doctrine of judicial review. Fine content A.Ms.S. "J. Marshall" 2pp., small 4to., [n.p., n.d.], offering a legal opinion of an estate case beginning with the significant facts of the case, in which a W. Edwards, deceased, leaves money to his children by his second wife, Lucy Pemberton. Marshall writes in part: "...I am further informed that the money mentioned in the will was paid to Lucy Pemberton them Lucy Edwards as the Guardian of her infant children...". In light of the father's death, the children of Edwards's first marriage apparently demanded a portion of the estate. Marshall notes: "...I consider the question concerning the validity of the payment as being too doubtful for the ex[eutor] to hazard the distribution of the residuary estate on the opinion of any lawyer...I am therefore decidedly of opinion that this is a case which ought to be laid before the chancellor by a friendly suit brot [sic] by the children of the second marriage against the ex[ecutor] & the children of the first. The same suit may procure a sale of the land without additional expense". Small losses from chipping along right margin, not affecting text, light dampstaining, otherwise very good condition. $2,500-3,500

317. REHNQUIST SUPREME COURT A fine signed book, The Illustrated History of the Supreme Court of the United States, by Robert Shnayerson, New York: Harry N. Abrams, 1986, 303pp. lg. 4to. hardcover with dustjacket. Signed on the half-title page by the entire Supreme Court c. 1988 including: WILLIAM H. REHNQUIST, WILLIAM J. BRENNAN, JR., BYRON R. WHITE, THURGOOD MARSHALL, HARRY A. BLACKMUN, JOHN PAUL STEVENS, SANDRA DAY O'CONNOR ANTONIN SCALIA, and ANTHONY M. KENNEDY. Minor wear to dustjacket, otherwise fine condition.$600-800

On the returning Bay of Pigs prisoners

318. ROBERT F. KENNEDY (1925 - 1968) American politician who successfully managed his brother John's presidential campaign and was later appointed Attorney General. He was assassinated in 1968 while running for president. Fine Bay of Pigs content T.L.S. on his official letterhead, 1p. 4to., Washington, Jan. 29, 1963 to John Shepherd of the INS thanking him "...For the work which you did in connection with the return of the Cuban Prisoners of Brigade 2506 on December 23 and 24. I appreciate how difficult it was for you not to be with your family at Christmas. But it was your unselfish devotion and dedication to your job which, combined with the efforts of many others, made it possible for these brave men to be with their families and relatives on Christmas after twenty months of suffering in prison". The members of Brigade 2506 were only returned after the U.S. paid a $53 million ransom of food and medicine to Castro's government. The returning prisoners were treated to a grand reception at the Orange Bowl in Miami. Usual folds, file holes and small staple holes a top margin, otherwise very good condition. $500-700

319. LOUIS D. BRANDEIS (1856 - 1941) Associate Justice of the Supreme Court, remembered for his powerful devotion to the freedom of speech. A.L.S. "L.D.B." 1p. 8vo., on Supreme Court letterhead, Washington, May 9, 1928 to a gentleman writing that he "...Was very glad of [?] brought aid to Miss Grady [?]...". At the end of Brandeis' initialed signature, his surname has been completed in another hand. With recipient's stamps, otherwise very good condition. $250-350

320. LEVI LINCOLN (1782 - 1868) American politician, Jefferson's Attorney general and Governor of Massachusetts, elected a member of the Continental Congress but declined to serve. Interesting D.S. as Governor of Massachusetts 2pp. folio, Boston, June 14, 1825 authorizing that "...Three suitable persons [be appointed] as Commissioners on the part of this Commonwealth for ascertaining and established the Boundary Line between the same and the State of Connecticut, east of the Connecticut River, so far as the same is in dispute...". The resolve also empowers the Commissioners to "...employ such surveyors and chain bearers as you may think proper...". Usual folds, otherwise fine condition. $200-300

321. DANIEL WEBSTER (1782 - 1852) American lawyer and statesman who verbally jousted with Calhoun in the Senate and later supported Clay's compromise measures on slavery. Ornate partly-printed D.S. "Danl. Webster" as Secretary of State with attractive eagle vignette, 1p. folio, Washington, Aug. 1, 1850, a passport issued to Newton S. Manross and bearing his physical description. Folds very lightly toned, else very good. $150-200
